It is unavailing to argue that all fortunetellers in Greenwood County are treated equally, for the class is constituted of fortunetellers in South Carolina, not fortunetellers in each of the separate counties of this State. Such a classification is repugnant to the guarantee of equal protection of the laws, because there is no rational basis upon which to establish such a classification

Thus, as long as the state permits the practice of fortune telling, it cannot discriminate among fortune tellers, creating preferred classes. Nor can it allow a county in the state to require fortune tellers to establish residency before they can acquire permits to practice their profession, since the class as a whole is made up of fortune tellers.
